Please read these Terms carefully. By accessing or purchasing from fancy-stuff.com ("Site"), you agree to be legally bound by these Terms. If you disagree, do not use the Site.

1. ACCEPTANCE & MODIFICATIONS

These Terms govern all users of the Site. We reserve the right to modify these Terms at any time, effective upon posting. Continued use of the Site after any modification constitutes acceptance. It is your responsibility to review these Terms periodically.

2. ELIGIBILITY

By using this Site, you represent and warrant that you are at least 18 years of age, have the legal authority to enter into these Terms, and are not barred from purchasing our products under applicable law. If you are under 18, you may only use the Site under supervision of a parent or legal guardian who agrees to these Terms on your behalf and assumes full responsibility.

3. PRODUCTS & AVAILABILITY

We reserve the right, at our sole discretion, to:

  • Limit, refuse, or cancel orders from any person, geographic region, or jurisdiction for any reason
  • Limit quantities purchased per person, household, or order
  • Discontinue any product at any time without notice
  • Correct any typographical errors, inaccuracies, or omissions — including after an order is submitted — and cancel any orders placed based on incorrect information, even after payment confirmation

Product descriptions, images, and specifications are provided for informational purposes only. We do not warrant that descriptions are accurate, complete, or error-free.

4. PRICING, PAYMENT & FRAUD

All prices are listed in US Dollars (USD) and are subject to change without notice. Prices do not include applicable taxes or shipping, which will be calculated at checkout.

By submitting payment, you represent that: (a) you are authorized to use the payment method provided; (b) the payment information is accurate; and (c) you will pay all charges incurred.

We reserve the right to refuse any order. In cases of suspected fraud, unauthorized transactions, or policy violations, we reserve the right to cancel orders, freeze accounts, and report activity to relevant authorities. You agree not to initiate chargebacks without first contacting us in good faith at hello@fancy-stuff.com. Fraudulent chargebacks constitute breach of these Terms and may result in legal action to recover damages, fees, and costs.

5. RETURNS & REFUNDS

All sales are subject to our Return & Refund Policy, which is incorporated herein by reference. We reserve the right to refuse returns that do not comply with our policy. We are not responsible for items lost in return transit.

6. ACCURACY OF INFORMATION

We do not warrant that content on this Site is accurate, current, or complete. Material is provided for general information purposes only and may not be relied upon as the sole basis for any decision. We expressly disclaim liability for errors or omissions.

7. INTELLECTUAL PROPERTY

You may not reproduce, distribute, modify, or create derivative works without our express written consent.

Links to third-party websites are provided for convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is at your own risk and subject to their terms.

9. USER-SUBMITTED CONTENT

By submitting reviews, comments, photos, or other content ("User Content"), you:

  • Grant Fancy Stuff US a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, translate, and distribute such content in any media
  • Waive any moral rights in such content to the fullest extent permitted by law
  • Represent that you own or have the right to submit such content and that it does not violate any third-party rights

We reserve the right to remove any User Content at our sole discretion.

10. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; OR (C) THE SITE OR SERVER IS FREE OF VIRUSES OR HARMFUL COMPONENTS.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANCY STUFF US, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR (B) US $50.00.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS — IN SUCH CASES, LIABILITY IS LIMITED TO THE MINIMUM EXTENT REQUIRED BY LAW.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Fancy Stuff US and its affiliates, officers, agents, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any User Content you submit.

13. FORCE MAJEURE

We shall not be liable for delays, failures, or disruptions resulting from causes beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, supply chain disruptions, carrier failures, or internet outages.

14. DISPUTE RESOLUTION — MANDATORY ARBITRATION

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. The arbitration will take place in Wilmington, Delaware. The arbitrator's decision is final and binding.

CLASS ACTION WAIVER: YOU AND FANCY STUFF US AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims of multiple parties.

You may opt out of arbitration by sending written notice to hello@fancy-stuff.com within 30 days of first accepting these Terms. Opting out does not affect any other provision.

Small claims court actions remain available to either party for qualifying disputes.

15. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. To the extent arbitration does not apply, you consent to exclusive jurisdiction and venue in the state and federal courts located in New Castle County, Delaware.

16. SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT & WAIVER

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Fancy Stuff US. Our failure to enforce any right or provision is not a waiver of that right. No waiver of any term shall be deemed a further or continuing waiver.
